Terms of Service

This English translation is provided for your convenience. Only the German version is legally binding.

  By registering for and using PushPig, you agree to these Terms of Service.
  Please read them carefully.

1. Scope

These Terms of Service apply to the use of the PushPig service available under the domain pushpig.de as well as all associated applications (Android app, browser extension, API). The operator can be found in the Imprint.

2. Registration and Account

Use of the service requires a user account. You must provide accurate information when registering.
You are responsible for the security of your password and your account.
Only one account per person is permitted. Multiple accounts may be blocked without prior warning.
You must be at least 16 years old to use PushPig.

3. Permitted Use

PushPig may be used exclusively for lawful purposes, in particular:

Sending your own notifications to channels you manage yourself
Automated notifications via the REST API from your own applications
Technical alerts and monitoring notifications
Information distribution for groups you belong to

4. Prohibited Content and Conduct

The following content and conduct are expressly prohibited:

Spam — mass, unsolicited or misleading sending of messages
Phishing and fraud — messages aimed at deception or data misuse
Malware — distribution of malware, viruses or harmful links
Illegal content — in particular CSAM, instructions for violence or drug trafficking
Hate speech and discrimination — content that attacks persons on the basis of their origin, religion, gender or sexual orientation
Threats — threats against persons or groups of any kind
Copyright infringement — distribution of content without authorization
Doxxing — publication of other persons' private data without their consent
Overloading the service — automated sending to an extent that impairs operation for others

5. Content Moderation

PushPig employs automatic content filters. Messages containing flagged terms are reported to the operator for review. In the event of breaches of these Terms, the account may be blocked or deleted without prior warning. There is no entitlement to restoration.

6. Availability and Liability

Under the Free plan, PushPig is provided as a free service without any guarantee of availability. The operator is not liable for damages resulting from outages, data loss or faulty deliveries. Use is at your own risk.

The operator reserves the right to restrict, modify or discontinue the service at any time without notice.

7. Pro Plan, Payment Processing and Term

In addition to the Free plan, we offer the paid PushPig Pro plan with extended limits and features. The respective current prices and scope of services are set out on the pricing page.

Payment is processed exclusively via our external payment service provider Polar Software, Inc., 548 Market Street PMB 61301, San Francisco, CA 94104-5401, USA. Polar is the "Merchant of Record" and thus your contractual seller; invoicing, value-added tax and refunds are handled via Polar.
The Pro membership is concluded on a monthly or annual billing interval and automatically renews for the chosen period unless terminated beforehand.
Termination is possible at any time as of the end of the current billing period via the Polar customer portal, which is linked in the Settings. Amounts already paid are not refunded on a pro rata basis.
When switching back to the Free plan, your existing data is retained. Free plan limits apply from the next time you create new channels, templates or API keys.

8. Right of Withdrawal for Consumers

Consumers (§ 13 BGB) are entitled to a 14-day right of withdrawal when concluding paid plans. The detailed cancellation policy including the model withdrawal form can be found on the Right of Withdrawal page.

Although Pro is activated immediately after the contract is concluded, we nonetheless waive the immediate-performance consent possible under § 356 para. 5 BGB. Your right of withdrawal therefore remains in place for the full 14 days, and upon timely withdrawal you receive the full payment back — even if you have already used Pro during that time. As a gesture of goodwill we waive any compensation for value under § 357a para. 1 BGB.

9. Data Processing Agreement (DPA) pursuant to Art. 28 GDPR

Anyone using PushPig in the course of a business activity and thereby processing personal data of third parties (e.g. recipient data during bulk sending or webhook payloads) requires a data processing agreement. Our DPA is concluded automatically upon registration with PushPig and forms part of the contractual relationship — a separate signature is not required. 10. Data Protection

Information on the processing of your personal data can be found in our Privacy Policy.

11. API Use

API keys may not be shared or published publicly.
Rate limits must be observed. Exceeding them may result in the API key being blocked.
Content sent via the API is subject to the same Terms of Service as manually sent messages.

12. Changes to the Terms of Service

The operator reserves the right to amend these Terms of Service at any time. Material changes will be communicated by a notification within the service or by email. Continued use of PushPig after a change constitutes acceptance of the new terms.
